1 Charlie Marshall and Eugenia Marshall, defendants in error herein, plaintiffs below, instituted an action in the district court of Blaine County, against C.H. Krieger, plaintiff in error herein, defendant below, to recover damages for a breach of warranty of seed wheat. Trial was had to a jury, and, pursuant to the jurys verdict, judgment was rendered in favor of the plaintiffs in the amount of $500. Motion for new trial was filed and overruled. From the order overruling the motion for new trial the defendant brought this appeal.
